RUTLAND — The Rutland Planning Board voted to rescind a $4,200 stone wall fine after new survey evidence emerged. Chair Norman Anderson's board found a surveyor's stamped letter showed the disputed wall sits on the developer's own property along Brintnell Drive, undercutting the town's scenic road bylaw case. "I don't believe I can conclusively now with this documentation... force the $4,200 fine," one member said.
A separate $300 paperwork fine remains pending. The board also approved a tri-party surety agreement for Phase IV of Bryce Estates and endorsed an Approval Not Required plan on Pleasantdale Road. Board member Timothy Nahrwold apologized for an earlier remark a viewer flagged as racially offensive, saying "I used the word shithole, and that was probably not the best terminology." Board member Alexander Maus raised unresolved questions about a promised sidewalk extension and heavy truck damage on Brintnell Drive.
