Mendon Planning Board Unanimously Amends 35 Cape Road Decision to Remove Permit Error

Mendon Planning Board votes unanimously to strip special permit language from a two-year-old site plan review decision for 35 Cape Road. The board, presided over by Vice Chairman Damon Tinio, invoked the rule of necessity twice — once to allow conflicted members to participate and once to achieve a valid quorum — before approving the corrective amendment at its June 17 meeting. The original August 2024 decision had been drafted using a template that blended site plan review and special permit boilerplate, and the erroneous special permit language surfaced as a title flag when the applicant attempted to move forward with a property transaction.

Town Planner Dylan Lindholm confirmed all substantive conditions of the original approval remain in place and that any future special permit application for the site would require a full new public hearing. The board also discussed shifting decision-drafting to applicants' attorneys, with Lindholm in a review role, to prevent similar template errors going forward.
