Charlton Conservation Commission fines City Depot Road developer for stormwater violations

CHARLTON — February 11, 2026 — Charlton Conservation Commission voted unanimously to fine the owner of 60 City Depot Road for stormwater violations after a January 14 EPA inspection found no tracking pad, an unpermitted trench near wetlands, unposted required signage, and a false claim to federal inspectors that McClure Engineering was conducting stormwater oversight. Conservation and Stormwater Director Rose Conway told the board the violations cover both the town's stormwater bylaw and the property's existing Order of Conditions, and that construction cannot resume until the site's roadway is completed. The commission also closed hearings and issued Orders of Conditions for projects at 140 Sandersdale Road, 3 Cranberry Meadow Shore Road, and 22 McIntyre Road, and extended an Order of Conditions for a solar project at 261 North Sturbridge Road. In old business, Conway briefed the commission on a potential unfulfilled 20-year-old state obligation: a town farm operated under a 10-year agreement lacks any documentation of commercial sales or CSA participation required under an Agricultural Preservation Restriction covenant, and the Massachusetts Department of Agricultural Resources is now requesting records — with a state land-protection fund payment as a possible alternative.
