Oakham conservation panel clashes with MassDEP over two days' notice for a disputed battery-storage site visit. The Conservation Commission unanimously fixed a clerical error in a Robinson Road home's Order of Conditions and voted 3-0 with one abstention to ratify an emergency beaver-dam removal at Farm Pond Road. Most of the meeting focused on Moraga Storage LLC's appeal of a denied battery storage project at 358 Coldbrook Road, after MassDEP emailed notice of a site visit at 5:09 p.m. the Friday before Labor Day.
"Well, why is their attorney going to be present?" one member asked, questioning why Moraga's attorney, Aaron Lang, would attend. Board of Selectmen Chairman Michael Brunel said any contact with town counsel must first clear the selectmen. Members noted the roughly $4,000 Wetlands Protection Fund may have to cover legal costs, and that Moraga's filing generated the town only about $200 against an estimated $1,700 collected by the state.
