Rutland's Conservation Commission withheld a certificate of compliance for 311 Pleasantdale Road after an as-built survey showed construction disturbed 9.6 percent of a 133,000-square-foot riverfront area, near the state's 10 percent cap, through boulder and slope work the commission said was never disclosed. Chair Jared Gentilucci asked staff to get updated disturbance figures before consulting MassDEP. "There's no point in conjecture.
We need clear guidance," Gentilucci said. The commission also heard a lengthy appeal from a Demmon Pond-area resident over new DCR enforcement banning swimming and boating under the 1992 Watershed Protection Act, which he said could cost him "three, four hundred thousand dollars" in property value; members said they lack jurisdiction but urged him to approach the Select Board. The commission also backed a rodenticide-ban warrant article for the 2027 Spring Town Meeting and issued three other compliance certificates.
